OFFICIAL RULES

 

NO PURCHASE NECESSARY TO ENTER OR WIN. MAKING A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.

 

1. ELIGIBILITY:

Heartland Coca-Cola’s 2025 Dierbergs Football Flyaway Sweepstakes (the “Promotion”) is open to legal residents living within the states of MO and KS (the “Territory”), who are age 21 or older and enrolled in the Dierbergs Rewards Program at the time of entry. Void outside the Territory, Puerto Rico, Guam, the U.S. Virgin Islands, outside the U.S., and wherever else prohibited by law.  Employees of Heartland Coca-Cola Bottling Company, LLC and Dierbergs Markets, Inc. (collectively, the "Sponsors"), The Coca-Cola Company, and CrowdTwist (“Promotion Administrator”), and their respective subsidiaries, affiliates, advertising and promotion agencies, and the immediate family members (spouses, parents, children, and siblings and their spouses) of, and/or those living in the same household of each, are not eligible to enter. The Promotion is subject to all applicable federal, state and local laws and regulations.

 

2. PROMOTION ENTRY PERIODS:

The Promotion begins at 12:30 AM Central Time (“CT”) on September 2, 2025, and ends at 11:59 PM CT on September 29, 2025 (the “Promotion Period”).

 

3. HOW TO ENTER:

There are three ways to enter to enter the Promotion, during the Promotion Period, via the Dierbergs.com website, the Dierbergs mobile app, or via mail.

 

Via Dierbergs.com website: To participate via website, go to www.Dierbergs.com.You must be signed in to your Dierbergs.com account to enter. Click the “Save” drop down button on the top navigation bar and select “Dierbergs Rewards” option. Click “Enter Sweepstakes.”

 

Via Dierbergs App: Open the Dierbergs App on your smart device and select the “Rewards” button at the bottom navigation. From there, select the “Sweepstakes” listing in the Rewards Marketplace and click “Enter Sweepstakes”.

 

Via Mail:  To participate by mail, type or handprint legibly in blue or black ink, on a piece of paper, your first and last name, age, complete postal address with ZIP Code (no P.O. Boxes allowed), email address associated with your Dierbergs account and preferred telephone number. Mail your entry in an envelope with proper postage affixed to: Dierbergs Markets, Inc., 16690 Swingley Ridge Road, St. Louis, MO 63017; Attn: Dierbergs Marketing Dept. All mail-in entries must be postmarked by September 26, 2025 and received by September 29, 2025. All incomplete or illegible entries will be disqualified. In the event of a dispute regarding the identity of an individual who submitted an entry by mail, the entry will be deemed submitted by the person named on the entry provided such person meets the eligibility requirements for the Sweepstakes.

 

Entries are limited to one (1) entry per person during the Promotion Period. Must be a Diebrergs Rewards Member. All methods of entry have an equal chance of winning.  All entries become the property of Dierbergs Markets, Inc. and will not be returned or acknowledged. Sponsors are not responsible for lost, late, damaged, misdirected, or postage-due mailed entries.  By entering into the Promotion, participants consent to the use of participant’s name, photograph, video, voice, biography, or likeness for advertising and promotional purposes, and without limitation and without additional compensation, except where prohibited by law.  Further, by entering into the Promotion, participant binds himself or herself, as well as participant’s spouse, children, parents, guardians, heirs, next of kin, and any legal or personal representative, executors, administrators, successors and assigns, to the terms and conditions contained herein.

 

4. PRIZES/APPROXIMATE RETAIL VALUE (“ARV”)/ODDS:

Prize(s): There will be a total of one (1) winner:  

Each winner will receive:

A Flyaway Trip for two (2) to see the Kansas City Chiefs vs. Denver Broncos in Denver, Colorado on November 16, 2025. Flyaway includes two (2) tickets to the November 16, 2025 game, 2 round trip airline tickets and hotel accommodations. 

 

The total ARV of winner’s prize available to be won: $4,000.00

Odds: Odds of winning will depend upon the total number of valid entries received.  All methods of entry have an equal chance of winning.

 

5. RANDOM DRAWING OF WINNER / WINNER NOTIFICATION & VERIFICATION:

A random drawing to determine the prize winner will be conducted by the Promotion Administrator, an independent representative of the Dierbergs Markets, Inc., whose decisions are final.  The prize winner will be randomly selected from among all eligible entries received during the Promotion Period.  The prize winner will be notified via email and/or phone and will be required to sign and return within four (4) days of notification, an Affidavit of Eligibility/Liability Waiver and an IRS W-9 Form, which is required for the sole purpose of tax reporting, as required by law (collectively, the “Releases”).  Noncompliance with the Releases or failure to provide signed Releases will result in disqualification and an alternate winner may be selected in a separate random drawing.

If a prize notification or prize is returned as undeliverable, or if the prize winner is found to be ineligible or not in compliance with these rules, that winner will be disqualified, and the prize may be awarded to an alternate winner in a separate random drawing.

 

6. PRIZE CONDITIONS:

Prizes are not redeemable for cash. Prizes are not assignable nor transferable. No substitution is permitted except if prize is unavailable, in which case a prize of equal or greater value will be awarded. No cash in lieu of prizes and no exchange or substitution of prizes, except at the sole discretion of the Sponsors. Any stated difference between the ARV and the actual value of the prize or any substituted prize will not be awarded. Any other incidental expenses on the prize not specified herein are the winner’s sole responsibility, including but not limited to any additional travel/transportation costs other than those specified herein, food and beverage costs, any flight or lodging upgrades or add-ons not specified herein, and any lodging incidentals. Sponsors reserve the right to substitute prizes as necessary.

Winners are responsible for all federal, state, local and income taxes associated with winning a prize. Except where prohibited by law, entry and acceptance of prize constitute permission to use winner's name, prize won, hometown, likeness, video tape, photographs, and statements for purposes of advertising, promotion, and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission.

EACH WINNER AGREES TO ACCEPT THE PRIZE “AS IS” WITH NO WARRANTY OR GUARANTEE, EITHER EXPRESS OR IMPLIED BY SPONSORS. WINNER(S) ACKNOWLEDGE THAT THE SPONSORS AND ANY OTHER COMPANIES/BUSINESSES AFFILIATED WITH THIS PROMOTION AND THEIR AGENTS DO NOT MAKE, NOR ARE IN ANY MANNER RESPONSIBLE FOR ANY WARRANTY, REPRESENTATIONS, EXPRESSED OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE QUALITY, CONDITIONS, FITNESS OR MERCHANTABILITY OF ANY ASPECT OF THE PRIZE BEING OFFERED. 

As part of accepting the prize “AS IS”, the prize winner is subject to any applicable terms, conditions, and rules associated with holding and using the applicable tickets and attending the applicable event. By entering the Promotion and accepting the prize, prize winners agree Sponsors and the other Released Parties (as defined herein below) have no control over (a) whether the applicable flight is delayed, transferred, cancelled or otherwise impacted in any way; and/or (b) whether the game/event for which tickets are provided to the prize winner is rescheduled, delayed, cancelled, or otherwise impacted in any way. In such case Sponsors shall have no obligation to provide any substitute prize or cash in lieu of a prize, and the prize winner will be subject to the refund, reschedule, or exchange policies, if any and as applicable, of the applicable airline, team, and/or third-party ticket management company, or any of their affiliates or agents.

Once the prize has been delivered to the winner’s provided address, email address, and/or relevant account, the prize is considered awarded.

 

7. GENERAL CONDITIONS:

Participants agree to these Official Rules and the decisions of the Sponsors and the Promotion Administrator, and release the Sponsors, the Promotion Administrator, The Coca-Cola Company, and each of their affiliated companies, and all other businesses involved in this Promotion, as well as the employees, officers, directors and agents of each (the “Released Parties”), from all claims and liability relating to participation in the Promotion, and the acceptance and use/misuse of the prize offered. Winner assumes all liability for any injury or damage caused or claimed to be caused, by participation in this Promotion or use/misuse or redemption of the prize. Sponsors are not responsible for any typographical or other error in the printing of the offer, administration of the Promotion or in the announcement of the prize.

Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. The Released Parties are not responsible for: (i) lost, late, misdirected, damaged or illegible entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsors on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to participant's or any other person's computer related to or resulting from participating in the Promotion. By participating in the Promotion, you (i) agree to be bound by these Official rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsors and the Promotion Administrator, which are final and binding in all matters relating to the Promotion. Failure to comply with these Official rules may result in disqualification from the Promotion. Sponsors reserve the right to: (i) permanently disqualify from any promotion it sponsors any person it believes has intentionally violated these Official Rules; and (ii) withdraw a method of entry if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Promotion). If for any reason this Promotion is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsors which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Promotion, the Sponsors reserve the right at their sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Promotion, at which time, Sponsors may choose to conduct a random drawing from among all eligible entries received at the time of the Promotion termination.

 

8. LEGAL WARNING:

ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN PARTICIPANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THIS WEB SITE OR INTERFERE WITH THE OPERATION OF THE PROMOTION, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

 

9. DISPUTES:

Except where prohibited, participant agrees that any and all disputes, claims, and causes of action arising out of, or connected with, the Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the state of Kansas.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of the Sponsors in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the state of Kansas without giving effect to any choice of law or conflict of law rules (whether of the State of Kansas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of Kansas. The remedy for any claim shall be limited to actual damages, and in no event shall any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney’s fees or other such related costs of bringing a claim, or to rescind this agreement or seek injunctive or any other equitable relief.

THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THIS AGREEMENT WHETHER SOUNDING IN CONTRACT OR TORT AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.

11. WINNER CONFIRMATION REQUEST:

For a written confirmation of the winners (available after Tuesday, September 30, 2025), send a stamped, self-addressed envelope (no later than Saturday, September 27, 2025), to: Coca-Cola and Dierbergs 2025 Football Flyaway Programming, Winner Confirmation Request, 3800 Mueller Road, St. Charles, MO 63301, Attn: Director Marketing.

Void outside the Territory, Puerto Rico, Guam, the U.S. Virgin Islands and wherever else prohibited by law.

 

12. DATA COLLECTION:

By entering the Promotion, participants agree that if they are the winner of the prize, personal data such as and not limited to the prize winner’s name, address, date of birth, email address, and phone number will be provided to Heartland Coca-Cola Bottling Company, LLC.  By participating in the Promotion, participants hereby agree to all lawful uses of personal data as explained in the Official Rules and as noted in Sponsor’s privacy policy at: https://heartlandcocacola.com/privacy-policy/.

 

 

Any applicable terms and conditions and/or privacy policy associated with the use of the Dierbergs website and/or Dierbergs mobile app shall also apply when using the Dierbergs website or mobile app for entry into the Promotion.

13. TRADEMARKS:

Company names and trademarks associated with prizes are used with permission solely for the purposes of identification of prizes. No endorsement, authorization, sponsorship, or approval of such entertainment venues, restaurants, or hotel accommodations associated with prizes is intended or implied by such use. All referenced company names and trademarks are registered trademarks or copyrights of their respective owners.
